1. Sales Agency
The commercialization of the services and products included in this website is carried out by Nunes Travel Agency, headquartered in R Bouça Real nº18, in the municipality of Póvoa de Lanhoso, Taxpayer Tax No. 506163016, with the registered capital of 250.000,00 €, registered in the Povoa de Lanhoso Land Registry / Commercial Registry and with the National Registry of Travel Agents and Tourism (RNAVT) nº 2588, hereinafter referred to as the Agency.
2. Object
These general contractual terms and conditions are designed to establish the terms and conditions governing the provision of travel services organized by the Agency in addition to any particular conditions agreed between the Client and the Agency, present on the Booking Form sent to the Agency. client.
The terms set forth in the Particular Conditions, if any, shall prevail over the provisions of these General Terms and shall prevail over both any additional written provisions specially agreed between the Client and the Agency.
The services and products are offered to Customer under the terms and conditions expressed herein.
By contracting with the Agency, the Client acknowledges and accepts all the terms and conditions established.
3. Access to the Site
When you access the www.nunesviagens.com page, you accept the terms set forth in these conditions of use. All copyrights, copyright, trademark and other applicable or used in this website belong to Nunes Viagens and are protected by copyright. All rights not expressly granted herein are reserved. This site is for your personal, non-commercial use. The copying, alteration, distribution, transmission, exhibition, reproduction, publication, transfer or sale of any information, products or services obtained through this website is prohibited. In no case may Nunes Viagens be liable, directly or indirectly, for any resulting damages or in any way related to the use of this website. Nunes Viagens does not guarantee that its web pages will not be interrupted or that they will not have errors and reserves the right to insert, change and remove, without prior notice and for whatever reason, any information present on the site. 4. Organization
The technical organization of the trips, services and products included in this site is the responsibility of different national and international tour operators. In no case shall the agency be liable for any resulting damages or in any way related to the use of the site. The agency does not guarantee that your web pages will have no errors or other difficulties. The agency reserves the right to manipulate, without prior notice and for any reason, any information on the site.
5. Registration
At the time of registration, the client must deposit a minimum of 25% of the price of the service, unless otherwise stated, to the customer in a timely manner, and settle the remaining amount up to 30 days before the start of the service. If the registration takes place 30 days or less from the date of the start of the service, the total price of the same must be paid at the time of registration, and this condition is conditional upon confirmation from the suppliers of the reservations for all services. Nunes Viagens reserves the right to cancel any subscription whose payment has not been made under the conditions mentioned above.
The amount of travel reserved to Nunes Viagens charges the following amounts as Reserve Rate for its services:
Reservations up to € 1,000 - € 25 per booking;
Reservations from € 1,001 to € 3,000 € -30 per booking;
Reservations over € 3,000 - € 35 per booking.
6. Complaints
Complaints can only be considered provided that they are submitted in writing to the agency within a maximum period of 20 working days after the end of the provision of services. They can only be accepted as long as they participate to the service providers during the course of the trip, requiring the same respective documents proving the occurrence.
In the event of a claim for non-compliance with the contracted services, the client may initiate the guarantee provided for in accordance with current legislation, and must present the respective complaint to Turismo de Portugal I.P within 20 working days of the end of the trip.
Pursuant to Law no. 144/2015 of September 8, we hereby inform you that the Client may use the following Alternative Dispute Resolution Entities:
• Customer Provider of Travel and Tourism Agencies at http://www.provedorapavt.com;
• Tourism Arbitration Commission of Portugal at http://www.turismodeportugal.pt;
• Or to any of the entities duly indicated in the list provided by the General Directorate of Consumer at http://www.consumidor.pt.
7. Baggage
The agency is responsible for the luggage under legal terms.
The customer is obliged to complain to the entity providing the services at the moment of subtraction, deterioration or destruction of luggage.
In the international transport, in case of damage in the luggage, the complaint must be made in writing to the carrier immediately after the verification of the damage, and a maximum of 7 days from its delivery. In case of a delay in the delivery of the luggage, the claim must be made within 21 days from the date of delivery.
The presentation of such a complaint will be an essential basis for triggering the responsibility of Nunes Viagens over the entity providing the service.
8. Documentation
8.1 Personal or Family Documentation
The client must have in good order his / her personal or family documentation, (identity card, military documentation, authorization for minors, visas, certificate of vaccines and others that may be required). The agency declines any responsibility for refusing to grant visas or not allowing entry to the client in a foreign country. In these cases, the conditions set out in the "Withdrawals" clause apply, and the client's account will bear all costs incurred.
Travel in the European Union:
Customers (regardless of age) who move within the European Union must have their civil identification document (passport; B.I, Citizen's Card);
To obtain medical assistance they must be holders of the respective European Health Insurance Card;
Non-EU nationals should consult specific information on the documentation necessary for travel to the embassies / consulates of the countries of origin.
Travel outside the European Union:
Customers (regardless of age) who are traveling must have their passport and visa if necessary (obtain this information from the agency at the time of booking);
Non-EU nationals should consult specific information on the documentation necessary for travel to the embassies / consulates of the countries of origin.
8.2 Travel Documentation to Send by the Agency
Nunes Viagens is a travel agency that preferably operates through its website (www.nunesviagens.com), so all travel documentation will be sent in electronic format to the customer area or to the email box.
If the client wants a physical copy of the documentation, although it is possible to send it electronically, you can request it from the agency. The documentation will be sent according to one of the following options, to be indicated by the client:
Sending of documentation to the indicated address (in 48h with an additional cost of € 10 per shipment in mainland Portugal);
Sending of documentation to the indicated address (express service in 24h with additional cost of 25 € per shipment in mainland Portugal).
8.3 Billing
The invoice will be sent to the email indicated by the client, in PDF format, in the case of a Certified Electronic Invoice. If the customer wishes to receive the invoice in physical format, the shipping conditions defined in 8.2 apply.
9. Changes
If the suppliers of the travel concerned allow, when a customer registered for a particular trip wishes to change his registration for another trip or to the same with departure from a different date, or any other change, he must pay the expenses associated with the change. However, when the change takes place 30 days or less in advance of the departure date of the trip for which the customer is registered, or if the service providers do not accept the change, he is subject to the expenses and charges in the item "withdrawals".
After starting the trip, if requested to change the services contracted for reasons not attributable to the agency (eg extension of the nights of stay, change of flight), the prices of tourist services may not correspond to those published in the brochure that motivated the hiring.
When booking confirmed holiday packages, Nunes Viagens will charge a fee of € 10 per change / person (plus any fees charged by the providers).
10. Assignment of registration
The customer can assign his / her registration, being replaced by another person who fulfills all the conditions required for the trip, provided that he / she informs the selling agency at least seven days in advance and that such assignment is possible under the transportation regulations applicable. In case of cruises and air travel the deadline will be fifteen days in advance. The assignment of the registration jointly blames the transferor and assignee for the payment of the trip price and for the additional charges originated.
11. Amendments
Whenever there are other reasons why, the organizing agency may change the order of the routes, modify the departure times or replace any of the hotels provided by others of similar category and location, and inform the client of such change as soon as it has knowledge. If unforeseen circumstances make it necessary to suspend any travel, customers will always be entitled to reimbursement of the amounts paid.
12. Cancellations of the program by the agency
When the trip is dependent on a minimum number of participants the Agency reserves the right to cancel the package trip if the number of participants reached is less than the minimum. In these cases, the client will be informed in writing of the cancellation of the trip.
13. Price change
The prices shown in the program are based on the costs of the services and exchange rates prevailing at the time of printing of this program and are subject to change resulting from changes in transport or fuel costs, duties, taxes, exchange rate fluctuations up to 20 days before the date of travel.
Whenever there is a change in the price of the trip, the customer will be informed immediately and invited to accept the increase verified or cancel its registration in the same terms and conditions as those provided for under the heading "Impossibility of greeting".
14. Refunds
Once the trip is started, no refund for unused customer services is due. Failure to provide services provided in the travel program for causes not attributable to the organizing agency and if it is not possible to replace them with other equivalent, gives the customer the right to be reimbursed for the difference between the price of the services provided and those actually provided.
15. Impossibility of compliance
If for reasons not attributable to the organizing agency this is unable to fulfill some essential service contained in the travel program, the client has the right to withdraw from the trip, being immediately reimbursed of all the amounts paid or, alternatively, accept an amendment and possible price variation.
If the said events that are not attributable to the organizing agency determine the cancellation of the trip, the client can still opt to participate in another organized trip of equivalent price. If the arranged trip proposed in substitution is of lower price, the customer will be refunded of the respective difference.
16. Withdrawal
The client or one of his or her escorts is free to give up or cancel the trip at any time. Such cancellation implies that it is responsible for the payment of all the charges to which the withdrawal gives rise and also to a percentage that can go up to 15% of the price of the trip. Where applicable, the customer will be reimbursed for the difference between the amount paid and the amounts referred to above.
17. Liability
The liability of the travel agency included in this site and arising from the obligations assumed, is guaranteed by civil liability insurance at Companhia Seguradoras Unidas, Companhia de Seguros, SA, policy number 0003682118, in the amount of 75,000.00 € and for the contribution to the Travel and Tourism Guarantee Fund (FGVT), according to the terms of the legislation in force.
17.1 Limit of Liability
The liability of the agency shall be limited to the maximum amount due to service providers under the Montreal Convention of 28 May 1999 on International Carriage by Air and the Berne Convention of 1961 on Rail Transport.
With regard to maritime transport, the liability of travel agents, in relation to their customers, for the provision of transport services or accommodation, where appropriate, by maritime transport undertakings, in the case of damage resulting from intent or negligence , shall be limited to the following amounts:
€ 441,436 in the event of death or personal injury;
€ 7,881, in the event of total or partial loss of luggage or damage to it;
€ 31,424 in the event of loss of a motor vehicle, including the luggage contained therein;
€ 10,375 in the event of loss of baggage, accompanied or not, contained in a motor vehicle;
€ 1.097 €, for damage to luggage, as a result of damage to the motor vehicle.
Where it exists, the responsibility of travel and tourism agencies for the deterioration, destruction and subtraction of luggage or other articles in tourist accommodation establishments, while the customer is staying there, has the following limits:
€ 1,397, globally;
€ 449 per item;
The value declared by the client, in relation to the articles deposited in the custody of the tourist accommodation establishment.
The agency's liability for non-personal damages may be contractually limited to the amount corresponding to five times the price of the service sold.
18. VAT
The prices mentioned in this program already reflect the Value Added Tax at the current rate.
19. Important Notes
Foreseeing possible errors, the valid prices will be only those that are communicated in writing in the confirmation of reservation of the requested services.
These general conditions may be supplemented by any other specific conditions, provided that they are duly agreed by the parties.
The prices of the programs are based on the average dollar exchange rate, so any relevant derivation of this currency may imply a revision of the prices of the trip under the terms of the "price change" clause.
Due to constant changes in the price of fuels on the prices charged, there may be a change in the fuel surcharge inserted in the price under the terms of the "price change" clause.
The categories of hotels and cruises follow the quality standards of the host country and may be changed by similar ones when, for reasons beyond the control of the agency, it is not possible to maintain or confirm the existing reservation, and the agency is obliged to inform the client soon that you are aware of.
20. General Information
Hours of arrival or departure:
The departure and arrival times are indicated at the time and place of their country and according to the schedules of their airlines at the time of printing of this program and may therefore be subject to change.
Hotels / apartments:
Apartments - In case the accommodation is hired in an apartment, it is the client's responsibility to provide information on the number of people who will occupy the apartment. If there are more people than booked, the apartments may refuse entry.
Hotels - The price shown is per person and is based on double occupancy. Not all hotels have a triple room and, as a rule, there is an extra bed that may not be of the same quality. In the rooms equipped with two single beds or a double bed, the triple room can only consist of these beds.
The list of hotels and apartments in the programs is indicative as well as their category, which respects local criteria and classifications sometimes different from those used in Portugal.
Meals:
Unless stated otherwise, prices quoted for the Half Board and Full Board supplements do not include beverages.
On arrival at the hotel after 7:00 pm the first meal service will be breakfast the next day. On the last day, and unless late check-out is possible, the last service of the hotel will be breakfast.
Food Regimens:
APA (Bed and Breakfast) - Includes Breakfast only;
MP (Half Board) - Includes Breakfast and Dinner.
PC (Full Board) - Includes Breakfast, Lunch and Dinner.
TI (All Including) - Includes breakfast, lunch, dinner, snacks and beverages such as water, juices and wine. Inclusions may be more comprehensive or restricted by destination and the hotel chain.
You should confirm with the Agency the Inclusions of the All Inclusive regime regarding your reservation.
Any specific Customer request regarding meals is always dependent on the supplier's confirmation and may entail payment of a supplement.
Meals that coincide with flight hours, transportation to and from the airport, or waiting times are not included in the package tours on a half-board or full-board basis.

Check in and check out times:
The arrival and departure times on the first and last day will be defined according to the first and last service. As a rule, non-binding, rooms can be used from 2 pm on the day of arrival and must be left free until 12 a.m. on the day of departure. In the apartments the entrance is usually verified by 5pm on the day of arrival and should be left free until 10am on the day of departure.
Special conditions for children:
Given the diversity of conditions applied to children (destination and supplier) it is recommended to always question the special conditions that may be applied to the trip in question.
Safe:
The agency offers the sale of insurance that can be purchased depending on the trip to guarantee assistance situations and cancellation expenses.
21. Jurisdiction and Legislation
These Terms and Conditions, as well as any relationship between the Agency and the User, shall be governed by the laws of Portugal. Except as expressly indicated, both parties are subject to the jurisdiction of the Portuguese Courts for any matter arising from the existence, content and / or interpretation of these general terms and conditions or any relationship between the Agency and the User.

The prices of the programs are based on the average dollar exchange rate, so any relevant derivation of this currency may imply a revision of the prices of the trip under the terms of the "price change" clause.
Due to constant changes in the price of fuels on the prices charged, there may be a change in the fuel surcharge inserted in the price under the terms of the "price change" clause.
The categories of hotels and cruises follow the quality standards of the host country and may be changed by similar ones when, for reasons beyond the control of the agency, it is not possible to maintain or confirm the existing reservation, and the agency is obliged to inform the client soon that you are aware of.
20. General Information
Hours of arrival or departure:
The departure and arrival times are indicated at the time and place of their country and according to the schedules of their airlines at the time of printing of this program and may therefore be subject to change.
Hotels / apartments:
Apartments - In case the accommodation is hired in an apartment, it is the client's responsibility to provide information on the number of people who will occupy the apartment. If there are more people than booked, the apartments may refuse entry.
Hotels - The price shown is per person and is based on double occupancy. Not all hotels have a triple room and, as a rule, there is an extra bed that may not be of the same quality. In the rooms equipped with two single beds or a double bed, the triple room can only consist of these beds.
The list of hotels and apartments in the programs is indicative as well as their category, which respects local criteria and classifications sometimes different from those used in Portugal.
Meals:
Unless stated otherwise, prices quoted for the Half Board and Full Board supplements do not include beverages.
On arrival at the hotel after 7:00 pm the first meal service will be breakfast the next day. On the last day, and unless late check-out is possible, the last service of the hotel will be breakfast.
Food Regimens:
APA (Bed and Breakfast) - Includes Breakfast only;
MP (Half Board) - Includes Breakfast and Dinner.
PC (Full Board) - Includes Breakfast, Lunch and Dinner.
TI (All Including) - Includes breakfast, lunch, dinner, snacks and beverages such as water, juices and wine. Inclusions may be more comprehensive or restricted by destination and the hotel chain.
You should confirm with the Agency the Inclusions of the All Inclusive regime regarding your reservation.
Any specific Customer request regarding meals is always dependent on the supplier's confirmation and may entail payment of a supplement.
Meals that coincide with flight hours, transportation to and from the airport, or waiting times are not included in the package tours on a half-board or full-board basis.

Check in and check out times:
The arrival and departure times on the first and last day will be defined according to the first and last service. As a rule, non-binding, rooms can be used from 2 pm on the day of arrival and must be left free until 12 a.m. on the day of departure. In the apartments the entrance is usually verified by 5pm on the day of arrival and should be left free until 10am on the day of departure.
Special conditions for children:
Given the diversity of conditions applied to children (destination and supplier) it is recommended to always question the special conditions that may be applied to the trip in question.
Safe:
The agency offers the sale of insurance that can be purchased depending on the trip to guarantee assistance situations and cancellation expenses.
21. Jurisdiction and Legislation
These Terms and Conditions, as well as any relationship between the Agency and the User, shall be governed by the laws of Portugal. Except as expressly indicated, both parties are subject to the jurisdiction of the Portuguese Courts for any matter arising from the existence, content and / or interpretation of these general terms and conditions or any relationship between the Agency and the User.
